حوزه و اسرار آن، ولایت فقیه و مشکلات آن

 (یکصد سال [1] پیش در زمان حکومت ناصرالدین شاه قاجار که که معاصر با آیت آلله میرزا حسن شیرازی مهم‌ترین آیه الله ایران بود، ناصر الدین شاه خواست تا امتیاز انحصار تنباکو را در برابر گرفتن مبلغ هنگفتی به انگلیسی‌ها واگذار نماید و مردم ملزم به تحویل تنباکو گردیدند.  [2]

آیه الله میرزا حسن شیرازی طی فتوائی کوتاه اعلام کرد: تنباکو از هم اکنون حرام و استفاده از آن در حکم آغاز جنگ با امام زمان است.  [3]

همان روز هنگامی که ناصرالدین شاه دستور آوردن قلیان را داد، یکی از همسرانش به وی گفت: کشیدن تنباکو حرام است. ناصرالدین پاسخ داد: من پادشاه و همسر تو هستم و به تو دستور می‌دهم.... همسرش در پاسخ گفت: آن کسی که من را بر تو حلال کرده، کشیدن تنباکو را حرام کرده است).

این داستان مشهوری درایران است که قدرت دین در برابر حکومت را نشان می‌دهد.

قم و حوزه علمیه را کسی که در آن درس خوانده می‌شناسد. کشف اسرار حوزه برای افراد غریبه بسیار مشکل است. حتما باید سال‌های زیادی را در آن سپری کنی تا با اسرار نهفته و تنوع و حقیقت آنچه که در آن می‌گذرد آشنا گردی. علیرغم شهرت حوزه، شناخت ازجریان‌های فکری موجود در آن اندک است. به ویژه هنگامی که بدانی قم و حوزه علمیه به صورت دائم در تغییر است.

حجت الاسلام محسن کدیور شاید بهترین شخص برای گفتگو در مورد حوزه باشد. وی بیش از ۱۷ سال در آنجا آموزش دیده و با آیت الله‌هایی که وجه مشترک آنان تفکراصلاح طلبی و نقد می‌باشد رفت وآمد داشته است.

محسن کدیور از شناخته شده‌ترین چهره‌های اصلاح طلب در ایران علاوه بر تدریس در دانشگاه مسئول انجمن حمایت از روزنامه نگاران نیز می‌باشد. انجمنی غیر دولتی که برای حمایت از آزادی مطبوعات تأسیس گردیده است.

کدیور در کنار اشتغالات دانشگاهی و روزنامه نگاری، کتاب «نظریه‌های حکومت در فقه شیعه» که در آن مهم‌ترین نظریه‌های فقهی شیعه پیرامون ولایت فقیه گردآوری شده را به رشته تحریر در آورده است.  [4] کدیور در این کتاب نشان می‌دهد که آیه الله خمینی چهارمرحله تفکر در مورد ولایت فقیه را پشت سر گذارده است. قم، نجف، پاریس و تهران.

کدیور به نقد و بررسی شکل گیری دمکراسی در اسلام پرداخته و بر آن است که نشان دهد اسلام ودمکراسی در کنار هم حرکت می‌کنند. او تلاش برخی علمای دین برای یکی نمودن آن را بیهوده و ناموفق می‌داند.

کدیور به خاطر عقایدش زندان اوین را تجربه کرد. زندان در تفکراتش از جمله اینکه ولی فقیه بعدی از تهران است نه قم و ولایت سیاسی به معنی «اداره حکومت ووکالت» است و نه سرپرستی افراد «محجور» و لذا مقتضای آن داشتن دانش سیاسی می‌باشد نه دانش دینی و فقهی، تغییری ایجاد نکرد.

من با کدیور در تهران ملاقات کردم و با وی پیرامون قم و پیچیدگی‌هایش، حوزه و راز‌هایش، موضع گیری‌ها و آینده آن گفتگو نمودم. و اینک متن گفتگو:
